SARS is on a drive to audit all non-compliant employers. Employers who have not withheld the accurate tax amount occur tax debt to the South African Revenue Service (“SARS”) and frequently find their tax exposures to be exceptionally large.

It is the employer’s obligation to withhold the correct Pay-As-You-Earn (“PAYE”) from remuneration paid to an employee and that the tax withheld is accurate and paid on or before the 7th day after the month in which remuneration was paid.
